Migration Review Tribunal
What does this Tribunal do and who can appear?
The tribunal is a merits review tribunal. Its main function is to provide an independent review of decisions made by either the Minister for Immigration and Citizenship or by officers of the Department of Immigration and Citizenship. The decision which is capable of reviews that decision which see a protection visa being refused to a non-citizen within Australia or to cancel protection visa’s.
Who can appear?
People who have applied and been denied a protection visa. If you are a refugee or a family member of a refugee the tribunal will consider your application and make a decision.
Time Limits
If your protection visa is denied upon your first application you will be notified of this decision. Once the decision has been made two time limits can apply:
- If you are not in immigration detention you have 28 to lodge your application.
- If you are in immigration detention – you must lodge the application within 7 working days.

The tribunal is located in Sydney and Melbourne. In Sydney it is on Level 11, 83 Clarence Street.
